Our platform helps you accurately evaluate, plan, and estimate software requirements by focusing on clear communication and comprehensive requirements analysis.
These Terms of Service (“Terms”) govern your use of the platform. By accessing or using Estimator, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not use our platform.
Definitions

Platform Definition: "Platform" refers to Estimator, which is a web platform for software requirements management.
User Definition: "User" any individual using the platform, including two types of users:
Manager: Responsible for managing requirements.
Team Member: Involved in understand and estimate the defined requirements.
Account Definition: "Account" the individual registration of an user on the platform.
Vision Definition: "Vision" refers to our guiding principle: To create solutions for Application Lifecycle Management, driving discovery and delivery through systematic execution, ensuring structured, efficient, and predictable outcomes for every project.
Services Provided

Estimator offers a web platform that facilitate relative estimates, planning, execution and evaluation for software requirements management, enabling effective communication and detailed requirement analysis. The services are provided based on the selected plan: Free, Basic, Advanced, or Business (see section 7). Paid plans offer both monthly and annual payment options.
The platform aims to provide support during both planning and execution stages, with the goal of improving accuracy and efficiency in software requirements management. However, the platform does not guarantee the success of sprints or specific results.
Eligibility

Estimator services are available only to users who meet the minimum age requirement of 16 years, as stipulated by European law. By using the platform, you declare that you meet the minimum age required to legally use our services.
Estimator Responsibilities

1.Provision of Services
Estimator provides a platform for requirements planning and execution, allowing Manager profiles to create and manage their own sprints. This includes:
Planning
Create your own workspace
Organizing sprint refinement sessions
Defining requirement dimensions (Functional and Non Functional)
Facilitating voting through relative inference
Determining the complexity of items before any development commitment
Use measurement for each sprint accordingly your maturity using Fibonacci
Execution
Following requirements status
Create requirement tasks
Create multiple test plans
Create Pipeline to control the quality of deliveries
Estimator aims to streamline this process through its suite of planning and execution tools, but the final decisions remain with the users (Managers and Team Members).
2.Service Availability
Estimator is a web-based platform accessible from any internet-enabled device with a compatible web browser or application, ensuring users can access the platform from anywhere at any time. While we strive to provide uninterrupted access to the platform, we cannot guarantee continuous availability, especially during maintenance and updates.
3.GDPR Compliance
Estimator is fully compliant with the General Data Protection Regulation (GDPR), ensuring that all personal and related data are handled in accordance with European data privacy standards. We have implemented appropriate technical and organizational measures to protect user data and adhere to GDPR principles. Users have the right to access, rectify, erase, restrict, or object to the processing of their personal data, as well as the right to data portability. 4.No Performance Guarantees
Estimator is currently in its Minimum Viable Product "MVP phase" and we do not provide performance guarantees at this stage. Users acknowledge that the platform may evolve and may have limited features or occasional performance fluctuations.
5.Downtime and Maintenance
Any planned downtime for updates or maintenance will be communicated to users at least 24 hours in advance in-app notifications. Maintenance is typically scheduled overnight to minimize disruption.
6.Data Ownership and Management
Estimator acts solely as a platform for managing requirements. The platform does not own the data entered by users; it only manages this data through its internal processes. The ownership of iteration requirements and related data remains with the user (Manager or Team Members).
Estimator is committed to protecting the privacy and security of user data in accordance with our Privacy Policy and applicable laws.
Estimator does not validate, control, or assume responsibility for the accuracy of the data provided by users. Users are responsible for ensuring the accuracy and validity of the data they input into the platform.
7.User Disputes
Estimator provides Managers with full control over the management of their teams, including the ability to add or remove Team Members from their projects. Any disputes between users (Managers and Team Members) regarding access, participation, or project management must be resolved between the parties involved.
Estimator reserves the right to intervene in disputes if they violate our platform's policies or terms of service.
8.AI Suggestions
Estimator uses user data solely to enable internal functionalities, such as providing AI-based tips to improve requirement writing. The user retains ownership of all content they create, while Estimator leverages this content only for improving platform services.
Estimator remains committed to protecting the privacy and security of user data in accordance with our Privacy Policy and applicable laws.
User Responsibilities

All users (Managers and Team Members) must provide truthful and complete information when creating their accounts.
Users agree to:
Use the platform in accordance with applicable laws.
Safeguard their login credentials.
Refrain from engaging in activities that may harm the platform or other users, such as distributing malware, infringing on third-party rights, or abusing the tools provided.
Maintain accurate and up-to-date account information.
Managers are responsible for accurately entering requirements and information.
Team Members are responsible for collaborating on execution based on the requirements provided.
Pricing and Payments

Estimator offers four service plans:
Free: Free access with limited functionalities.
Basic: Paid plan that includes limited resources.
Advanced: Paid plan that includes more platform resources.
Business: Paid plan for all size of businesses.
Pricing for paid plans has not yet been defined. Payment options may be monthly or annual, depending on the selected plan.
Refund Policy

Estimator offers a 14-day trial period for users to explore and experiment with our platform before committing to a paid subscription. During this trial period, users can cancel their subscription without incurring any charges.
After the 14-day trial period, users will be charged for their chosen subscription plan.
By subscribing to a plan, the User acknowledges and agrees that payments are non-refundable under most circumstances. Users may cancel their subscription at any time, but no refunds will be provided for the remaining subscription period. Exceptions may apply in accordance with applicable EU and Portuguese consumer protection laws. If you have any questions or concerns about our refund policy, please contact our customer support team before subscribing to a plan. By subscribing to a plan, you accept and agree to these terms.
Intellectual Property

Estimator acknowledges that users retain all intellectual property rights over the requirements and content they enter into the platform.
By using Estimator, users grant us a non-exclusive, worldwide, royalty-free license to use, copy, and process their content for the sole purpose of providing platform services, including AI-based tips to improve requirements writing. Estimator will not use user content for any other commercial or promotional purposes without their prior consent.
Estimator respects the intellectual property rights of others and expects our users to do the same. Users are responsible for ensuring that the content they upload or share on the platform does not infringe on any third-party intellectual property rights.
Privacy Policy and Cookies

At Estimator, we are committed to protecting the privacy of our users and ensuring the transparent use of their data. We collect and process user data in accordance with our Privacy Policy and applicable data protection laws. This includes personal data provided during account registration, as well as data generated through the use of our platform.

Termination and Suspension

Estimator reserves the right to suspend or terminate the access of any User who violates these Terms of Service, engages in misconduct, or misuses the platform. Users may request account cancellation at any time, but account cancellation does not automatically entitle users to a refund for any paid services. In the event of termination or suspension, users may lose access to their account, data, and any other platform features. Estimator is not responsible for any consequences or losses resulting from account suspension or termination due to violations of our Terms of Service.
Limitation of Liability

Estimator shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost profits, business interruptions, or data loss resulting from the use or inability to use the platform. Estimator provides the platform "as is" and does not guarantee specific results or outcomes from its use.

Users acknowledge and agree that they are responsible for their own use of the platform and any decisions or actions based on the information obtained through Estimator. Estimator does not assume any responsibility for the accuracy, completeness, or reliability of user-generated content, and users rely on such content at their own risk.

In no event shall Estimator's total liability to any user exceed the amount paid by the user for the use of the platform during the preceding 12 months, if any. This limitation of liability is an essential part of these Terms of Service and forms the basis for users to access and use the Estimator platform.
Changes to the Terms

Estimator reserves the right to modify these Terms of Service at any time. We will notify users of any significant changes through email, in-app notifications, or by updating the "Last Updated" date at the top of this document. It is the user's responsibility to review and understand the updated Terms of Service.

Continued use of the platform after changes have been made constitutes acceptance of the updated Terms. If users do not agree to the modified Terms, they must discontinue the use of Estimator.
Dispute Resolution

Any disputes arising from or related to the use of Estimator shall be resolved through mediation or arbitration, as permitted by applicable law. The governing law and jurisdiction for any such disputes shall be the laws of the EU member state where the user is domiciled, and users agree to submit to the exclusive jurisdiction of the courts in that member state. This provision does not limit any consumer protection rights users may have under applicable laws.
General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy and any other documents referred to herein, constitute the entire agreement between the parties and supersede all prior agreements, understandings, and representations, whether written or oral.

These Terms are written in English, and any translations provided are for convenience only. In the event of any conflict or inconsistency between the English version and any translated version, the English version shall prevail.
